． 高雄市電影館係依據本《使用者服務條款》（以下稱本服務條款）提供您2022高雄電影節線上影展平台影音之所有相關服務（包含短片及競賽電影等），包括但不限於現有或未來新增之各項服務（以下統稱「本服務」)。
． 當您使用本服務並完成註冊手續成為本服務會員時，即表示您已閱讀、瞭解並同意接受本服務條款之所有內容。高雄市電影館有權於任何時間修改或變更本服務條款之項目或內容，修改後的條款內容將公佈於本服務之網站上，建議您隨時注意該等修改或變更。您於本服務條款項目或內容經任何修改或變更後繼續使用本服務，視為您已閱讀、瞭解並同意接受該等服務項目或內容變更。如您不同意本服務條款之內容全部或部份，或者您所屬的國家、地域之法律排出本服務條款內容之全部或部份之適用時，您應立即停止使用本服務。若您為未滿十八歲，除應符合上述規定外，並應於您的家長（或監護人）閱讀、瞭解並同意本服務條款之所有內容及其後之修改變更後，方得使用或繼續使用本服務，並遵守電影分級制度。當您使用或繼續使用本服務時，即表示您的家長（或監護人）已閱讀、瞭解並同意接受本服務條款之所有內容及其後之修改變更，亦同意受使用條款之拘束。
． 2022高雄電影節線上影展採用Shift 72影音串流平台，提供個人化訂閱服務，讓會員使用可上網的電視、電腦或其他特定裝置，觀賞網路串流傳輸的節目(「2022高雄電影節線上影展內容」)。
． 您對我們服務的使用受本服務條款約束。本服務條款所稱「2022高雄電影節線上影展服務」、「我們的服務」或「本服務」，是指2022高雄電影節線上影展所提供搜尋及觀賞其內容的個人化服務，包括所有特性與功能、推薦與評論、網站與使用者介面，以及與我們服務相關的所有內容與軟體。
2. 會員
． 欲使用本服務，必須加入平台會員，才可開始選取您要觀看的節目。在您確認付款前我們不會向您收取任何費用。
． 您同意於註冊時需填寫正確且符合真實之個人資料及有效電子信箱，才能收到消費明細、重設密碼連結等信件及其他相關通知。
3. 促銷優惠
． 您同意以註冊時提供之電子信箱接收由本服務發出之促銷方案及優惠折扣碼。
． 優惠資格由2022高雄電影節全權酌情決定，若我們認定您不符資格，我們有權取消優惠或暫停您的帳戶。
． 優惠序號由2022高雄電影節統一發出，僅供本人使用，不得與他人共用，若經由主辦方發現，我們有權取消優惠或暫停您的帳戶。
4. 付款準則
． 使用本服務前，您必須先選擇您欲觀看的影片並使用有效的「信用卡或簽帳金融卡」進行付費，若因過期、資金不足或其他原因導致付款失敗，將導致購票失敗無法正常觀影。您的發卡機構可能會向您收取特定費用，例如跨國交易手續費或其他與您相關的處理費用。請自行聯絡您的發卡機構，以了解可能會收取哪些費用。高雄市電影館並不負責這些費用，亦不提供退費。
． 本線上影展係與國外影音平台Shift 72合作，相關退換票涉及與國外平台間計算，故無法適用退換票規定，每部節目結帳完成後，按下播放鍵後將開始倒數，48小時內需觀影完畢，恕不接受退換貨，亦無配合七天鑑賞期內可退貨條款，請於結帳前慎重考慮再進行付款動作。如觀影時間過期或因自身原因錯過播放時間導致無法觀看，恕不接受展延或退票。部分影片亦有特殊觀影期限，敬請留意。所有影片則將於10.30（日） 23:59下架，請自行斟酌片長並把握觀影期限。
5. 觀影準則
． 本服務及透過服務所觀賞的任何內容僅供您個人觀賞使用，不可作為商業用途，也不得共享帳號觀看，嚴禁盜錄轉載（您購買的影片上將壓印您的註冊ID作為防盜浮水印)。影片購票完成後，在您的有效觀影期間內，我們授予您有限、非專屬、不得轉讓的權利，以使用本服務並觀賞2022高雄電影節線上影展內容。除上述事項外，我們不向您轉讓任何權利、所有權或利益。您同意不使用此服務進行公開播放。
． 您同意根據所有適用法律、規則和規範或針對此服務或內容的其他使用限制規定使用本服務，包括與其相關的所有特性和功能。您同意不存檔、重製、散布、修改、展示、公開播放、出版、授權、製作衍生作品、出售或使用(除非本服務條款明確授權) 本服務所含的內容和資訊或從本服務或透過2022高雄電影節線上影展取得的內容和資訊。您還同意不：規避、移除、更改、停用、降級或妨礙本服務的任何內容保護措施；使用任何網路機器人(robot)、網路蜘蛛(spider)、網路抓取(scraper)程式或自動化方式來取用本服務；將透過本服務取得的任何軟體或其他產品或程式進行反解釋、進行還原工程或反組譯；插入任何程式碼或產品或以任何方式操控本服務的內容；或使用任何資料探勘、資料收集或資料擷取方式。此外，您同意不上傳、發佈、以電子郵件傳送或以其他方式發送或傳輸任何旨在干擾、破壞或限制與本服務相關的任何電腦軟體或硬體或電信設備功能的資料，包括任何軟體病毒或其他任何電腦程式碼、檔案或程式。如果您違反本服務條款或以非法或詐欺之圖使用服務，則我們可終止或限制您使用我們的服務並尋求法律途徑。
． 2022高雄電影節線上影展平台僅供透過2022高雄電影節線上影展相容裝置進行獲授權之串流及觀賞2022高雄電影節線上影展內容使用。本服務可能因個別裝置與媒體而有所不同，且不同裝置之間的功能與特性亦有差異。您必須自行負責所有必要條件設置，以順利存取平台服務及內容。然而，平台仍可能發生無法在已提及之設置條件上運行的情況，除較舊的硬體（筆電、平板、手機）、瀏覽器和作業系統外，亦有少數情形為：上述提及設備／產品之品牌，在推出新版本服務或更新時，可能有尚未發現的技術漏洞及缺陷，屬於非本平台提供技術服務之問題，高雄市電影館並不負責任何補償，亦不提供退費。
． 2022高雄電影節線上影展服務是依「現狀」提供，不提供任何擔保並不附條件，我們的服務不可能不受到干擾或不出現錯誤。您同意放棄對我們請求任何特殊、間接及衍生性的損害賠償。這些條款不限制您依據居住國家／地區強制法所享有的任何不可放棄的擔保或消費者權利。
． 高雄電影節線上影展內容顯示和觀影體驗可能因裝置不同而有差異，而且可能受到多種因素的影響，例如您所在的位置、可用頻寬、相容裝置或網路連線速度與穩定度。可否以高畫質(HD，即720p或1080p)播放受到網路服務與裝置本身性能的限制。並非所有內容均能以原始格式播放。高畫質的最低連線速度為7Mbps；建議觀賞高畫質內容時，使用每個串流至少5.0Mbps的下載速度接收。所有網路連線費用由您自行承擔。請諮詢您的網路提供者，了解適用的網路數據費用資訊。
1. Definition
．The Kaohsiung Film Archive provides all audiovisual services related to the 2022 Kaohsiung Film Festival Online Platform in accordance with the User Terms of Service (hereinafter referred to as “Terms of Service”), including feature films, short films, and competition films, which includes but is not limited to existing or new services (hereinafter referred to as “the Services”).
．By using the Service and completing the registration process to become a member of the Service, you acknowledge that you have read, understood, and agreed to accept all of the terms and conditions of the Service. The Kaohsiung Film Archive reserves the right to modify or change any item of the content of these Terms of Service at any time, and the modified content will be posted on the Service’s website. Your continued use of the Service after any modification or change to these Terms of Service shall be deemed to indicate that you have read, understood, and agreed to accept such modification or change. If you do not agree with the Terms of Service in whole or in part, or if the laws of your country or jurisdiction exclude the application of the Terms of Service in whole or in part, you should immediately discontinue using the Service. If you are under 18 years of age, in addition to the above, you may not use or continue to use the Service until your parent (or guardian) has read, understood, and agreed to all of the Terms of Service and any subsequent changes to the Terms of Service, and have complied with the movie rating system. By using or continuing to use the Service, you represent that your parent (or guardian) has read, understood, and agreed to accept all of these Terms of Service and any subsequent changes thereto, and agrees to be bound by these Terms of Service.
．The 2022 Kaohsiung Film Festival Online uses the Shift 72 streaming platform to provide personalized subscription services that allow members to view programs (“2022 Kaohsiung Film Festival OnlineContent”) streamed over the Internet using a television, computer, or other specific devices with Internet access.
．Your use of our service is subject to these Terms of Service. The “2022 Kaohsiung Film Festival Online Film Festival Service”, “Our Service” or “the Service”mentioned in these Terms of Service refers to the personalized service provided by 2022 Kaohsiung Film Festival Online to search and view its content, including all features and functionality, recommendations and reviews, website and user interface, and all content and software associated with our service.
2. Members
．In order to use the Services, you must join the platform membership in order to start selecting the programs you want to watch. We will not charge you any fees until you have confirmed your payment.
．You agree to fill in the correct and true personal information and a valid email address when registering. You will receive a confirmation email after you have successfully paid for any item.
3. Promotional Discount
．You agree to receive promotional offers and discount codes from the Service at the email address provided at the time of registration.
．Eligibility for discount is at the sole discretion of the 2022 Kaohsiung Film Festival and we reserve the right to cancel the offer or suspend your account if we determine that you are not eligible.
．The discount code is issued by the 2022 Kaohsiung Film Festival and is for your use only and cannot be shared with others. If found by the organizer, we have the right to cancel the offer or suspend your account.
4. Payment
．Before using the Service, you must select the film you want to watch and pay with a valid “credit or debit card.” If the payment fails due to overdue, insufficient funds, or other reasons, the purchase will fail and you will not be able to watch the film. Your card issuer may charge you certain fees, such as international transaction fees or other associated processing fees. Please contact your card issuer to find out what fees may include. The Kaohsiung Film Archive is not responsible for these charges and does not offer refunds.
．The online film festival is in collaboration with Shift 72, a foreign audiovisual platform, refunds and exchanges are calculated between the foreign platform and the online film festival, thus, refunds and exchanges are not applicable. Upon checkout for each program, the countdown will begin after pressing the play button, and all films must be viewed within 48 hours. No refunds or exchanges will be accepted, and it is not subject to the 7-day grace period regulation. Please consider placing your order carefully before purchasing. If the viewing period expires or if you miss the screening time due to personal reasons, no extensions or refunds will be accepted. Please note that some films have special viewing deadlines. All films will be taken down at 11:59 pm on Sunday, 30th OCT. Please be aware of the length of the film and the viewing period at your own discretion.
5. Viewing
．The Service and any content viewed through the Service is for personal viewing only and may not be used for commercial purposes, nor may it be viewed by sharing your account with someone else. In addition, piracy is strictly prohibited (your registration name will be embossed on the film you purchased as an anti-piracy watermark). You will be granted a limited, non-exclusive, non-transferable right to use the service and view the contents of the 2022 Kaohsiung Film Festival Online Film Festival during your valid viewing period after the purchase of the film. Except as set forth above, we do not transfer any right, title, or interest to you. You agree not to use the Service for public broadcast.
．You agree to use the Service, including all features and functionality associated with it, in accordance with all applicable laws, rules, and regulations, or other restrictions on the use of the Service or the content. We may terminate or restrict your use of the Services if you violate these Terms of Service or use the Services in an unlawful or fraudulent manner.
．The 2022 Kaohsiung Film Festival Online platform is only available for authorized streaming and viewing of its content through the 2022 Kaohsiung Film Festival Online Film Festival compatible devices. The Services may vary depending on the device and media you choose, and features and functions may also vary between devices.
．The Services of the 2022 Kaohsiung Film Festival Online are provided “as is” without warranty or condition and cannot be guaranteed to be uninterrupted or error-free. You agree to waive any claim against us for particular, indirect, and derivative damages. These terms do not limit any non-waivable warranty or consumer rights you may have under the mandatory laws of your country of residence or jurisdiction.
．The user experience and picture quality of the Kaohsiung Film Festival Online content may vary from device to device and may be affected by a number of factors, such as your location, available bandwidth, devices, or the speed and stability of your Internet connection. The availability of high-definition (HD, 720p or 1080p) playback is limited by the network service and the performance of your device. Not all content can be played in its original format. The minimum connection speed for HD is 7Mbps; it is recommended that you use a download speed of at least 5.0Mbps per streaming to receive HD content. All Internet connection fees are your responsibility. Please consult your network provider for information on applicable network data charges.
